Pupil
Behavior & Discipline
The
Clinton City Board of Education has adopted a Code of Pupil
Behavior and Discipline for all schools. A copy of this
code is distributed to all staff members and parents at the
beginning of each year. Students are expected to behave in an
appropriate manner and violations of the code may be accompanied by
serious consequences.
The
principal is responsible for the maintenance of good order and
discipline within the school and all its sponsored activities.
Each teacher is responsible for and shall have authority for the
maintenance of order within the classroom that is conducive to
learning. Appropriate behavior is imperative at all schools
and school-sponsored activities.
Damage
to Property
Pupils
who intentionally destroy or damage any school property shall pay
for such destruction or damage according to the value set by the
school authorities, but this value shall not exceed the cost of full
repair or replacement. This includes school and
school-sponsored activities during and after school hours.
Disruption
and Interference of School Activities
A
student shall not use violence, force, noise, coercion, threat,
intimidation, fear, passive resistance, or any other conduct which
causes the disruption, interference or obstruction of any school
purpose while on school property, in school vehicles or buses, or at
any school-sponsored activity, function or event, whether on- or
off-campus. Neither shall he/she urge other students to engage
in such conduct. Any student committing battery upon an
employee of the Clinton City Schools will be expelled for one
calendar year. (99th General Assembly, 1996 SB 2116 and HB 2861)
Pupil
Speech and Behavior
A
student shall not use vulgar language or behave in a manner
considered by society to be vulgar, abusive, profane or obscene. Any
student exhibiting such language or behavior shall be referred to
the principal's office at the teacher/staff members'
discretion. Examples of this type of language or behavior
include (but are not limited to) profanity, a defiant challenge to a
staff member concerning class or school rules, abusive behavior or
intimidating others to become disorderly.
Substance
Abuse Policy
No
student shall use, possess, or be under the influence of any illegal
or non-prescribed narcotic drug, amphetamine, barbiturate,
hallucinogenic drug, legend or controlled substance, marijuana,
alcoholic beverage, paint, glue, or intoxicant of any kind in the
following situations:

on school grounds during,
immediately before, or immediately after school hours;
-
on the grounds at any other
time when the school is being used by any school groups; or
-
off the school grounds at a
school activity, function, or event.
Any
student who furnishes, uses, or possesses any of the above mentioned
substances, counterfeit substances, synthetic substance, or who
furnishes a simulated or look-alike substance and who expresses or
implies that the substance is a controlled substance, will be
reported to the Clinton Police Department by the school
authorities. Students admitting or having the above
charges proven to be true by the school authorities and/or police
shall be placed on probation and/or suspended. The student
shall appear before a show cause hearing board at a date to be
determined by the assistant director of schools.
The
student shall have the opportunity to appeal the decision of the
show cause hearing to the Disciplinary Hearing Authority and/or
Board of Education, pursuant to Board policy J-10 and TCA
49-6-34001.
Definitions
Substance
Abuse
The use, furnishing or possession of any illegal or non-prescribed
narcotic drug, hallucinogenic, amphetamine, barbiturate, marijuana,
paint, glue, beer, alcohol, or intoxicant of any kind.
Counterfeit
Substance
A controlled substance which, or the container or labeling of which,
without authorization, bears the trademark, trade name or other
identifying mark, imprint, number or device, or any likeness
thereof, of a manufacturer, distributor or dispenser other than the
person who in fact manufactured, distributed, or dispensed the
substance.
Synthetic
Substance
A synthetic substance is a chemical compound that has the same or
similar effect of any illegal drug, legend or controlled substance,
hallucinogenic, barbiturate, amphetamine or intoxicant, made by the
artificial combination of elements by any physical or chemical
process.
Simulated
or Look-Alike
A non-controlled substance furnished with the implication that it is
a controlled substance. It may or may not have the markings or
label of a controlled substance. Example: Caffeine is a
look-alike substance if it is furnished with the implication that it
is or is a substance for PCP.
Selling/Furnishing
The exchange, transmittal, and/or supplying of any article defined
in this policy as substance abuse regardless of whether the purpose
of such exchange, transmittal and/or supplying was for profit or
given without monetary and/or other compensation.
Probation
A state of disciplinary action assigned to a student involved in the
violation of school rules and/or policies. Should subsequent
misbehavior/rules violations occur, suspension from attending school
shall be determined by the Director of Schools, his/her designee,
and/or the Board of Education. A student may or may not be
excluded from attending school for a designated period of time
during the probationary period.
A student may or may not be excluded from school for a designated
period of time during the probation period if the director of
schools and Board of Education so determine.
Illegal
Items
No student shall have
in his/her possession at school items such as illegal drugs,
tobacco, matches, razor blades, knives, knucks, or any other item
designated to inflict harm to others, or cause damage to property.
